HC directs DGP to submit Compliance Report or appear in person

JAMMU, JULY-29 : Justice Mohd Yaqoob Mir in a contempt petition filed by one Rajinder Kumar Bhardwaj Vs Samuel Vergeese & Ors directed that the judgment shall be implemented within a period of two weeks and compliance report be submitted. In case of non-compliance, Director General of Police shall remain personally present on next date of hearing. The petitioner filed a contempt petition whereby the respondents failed to compliance the judgment of the High Court whereby the High Court directed that the petitioners who came to be appointed as ASI on August 17, 1982 treated to have been appointed Sub-Inspector from August 17, 1982 and extended them the benefits of the promotion notionally taking the date of their first appointment for the purpose of seniority.
Justice Mohd Yaqoob Mir after hearing Sr. Adv MK Bhardwaj with Adv Ajay Abrol for the petitioner whereas Additional Advocate General Mr. Jagdish Parihar appearing for the respondent observed that personal appearance of DGP pursuant to order July 15, 2010 was dispensed within view of the prevailing situation in the valley, but at the same time 10 days time was granted for implementing the judgment. Again application is moved for exemption on the same grounds, in addition, it has been projected that review petition has also been filed but counsel for the appellants submitted that due to unavoidable prevailing circumstances, Director General of Police was not in a position to attend other matter, therefore, not only exemption but extension of time for implementation of judgment may be granted. Though Senior Advocate Mr. MK Bhardwaj for the petitioners has seriously opposed this request as according to him ample time has been given to respondents to implement the judgment and they are trying to evade the process of law. Upon this Court said that considering the submissions, the ground projected for exemption is cogent.

Therefore, exemption is granted for today's appearance. It is made clear that the judgment shall be implemented within a period of two weeks, from today and compliance report be submitted. In case of non-compliance, Director General of Police shall remain personally present on next date of hearing and directed the registry to list the case in week commencing August 9, 2010. JNF
